Terms of Use

Notary Tracker offers auto-renewable subscriptions to unlock premium features. By subscribing, you agree to the following:

• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the end of the current period.
• Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase and on each renewal.
• Pricing: Current subscription prices are displayed in the app prior to purchase. Promotional or founding-member pricing, when offered, is locked in for the lifetime of the subscription as long as the subscription remains active and uncancelled.
• Cancellation: You may cancel your subscription anytime from your Apple ID Subscription Settings (iOS) or Google Play Subscriptions (Android). Cancellation takes effect at the end of the current billing period; no partial refunds for unused portions.
• Refunds: Refunds are handled by Apple or Google per their respective policies. Brainmonger LLC does not process refunds directly.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

You are responsible for: (a) the accuracy of all notary journal entries, appointment records, client data, and expense entries you create; (b) compliance with all applicable laws and notarial commission requirements in your jurisdiction, including journal retention rules; (c) maintaining the confidentiality of your account credentials and any biometric / passcode used to unlock the app; and (d) all activity that occurs under your account.

Notary Tracker is a recordkeeping tool. You remain solely responsible for following your state's notary laws and for the legal validity of your notarial acts.

You agree not to: (a) reverse-engineer, decompile, or attempt to extract source code from the app; (b) resell, lease, or sublicense access to the app; (c) use the app for any unlawful purpose; (d) interfere with or disrupt the app or its servers; or (e) circumvent any access controls or subscription requirements.

Notary Tracker, including its software, design, branding, and content (excluding your journal entries, client data, and other content you enter), is owned by Brainmonger LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws.

You retain ownership of your notary journal entries, client information, appointments, and other content you enter into the app. We process your data as described in our Privacy Policy. You may request deletion of your account and associated cloud data at any time from within the app (Settings → Account → Delete Account).

NOTARY TRACKER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

Notary Tracker is a tool to assist notary professionals; it does not replace professional judgment, training, or compliance with your state's notarial laws and journal-retention requirements.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINMONGER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF NOTARY TRACKER. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR TWELVE (12) MONTHS, OR $50 USD, WHICHEVER IS GREATER.

We may suspend or terminate your access to Notary Tracker at any time if you violate these Terms. You may stop using Notary Tracker at any time by uninstalling the app and cancelling your subscription. Sections 6, 8, 9, and 11 survive termination.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any dispute arising from these Terms or use of Notary Tracker shall be resolved in the state or federal courts located in Orange County, Florida.

If you obtained Notary Tracker from the Apple App Store, you acknowledge that these Terms are between you and Brainmonger LLC, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of any failure to conform to applicable warranties, you may notify Apple, who will refund the purchase price (if any); Apple has no other warranty obligation whatsoever. Apple is a third-party beneficiary of these Terms and may enforce them against you.

We may update these Terms from time to time. Material changes will be notified via the app or via the email address on your account. Continued use after changes constitutes acceptance.
